Sales and Health Contract
All puppies and adults are as accurately described as possible and are guaranteed to be healthy and "as we have represented" at the time of the sale. Our animals are priced according to pedigree, quality, breeding history and/or possible future potential. We make no guarantees implied or otherwise that any animal sold will gain any type of show title, but that they exhibit certain potential and a possibility of doing so based on our evaluation at the time of the sale. Any know faults will be discussed with the buyer before a puppy is purchased. Koda Ranch reserves the right for pick of the litter on any and all litters. If, for any reason, the owner can not keep the puppy/dog, the puppy/dog must be returned to Koda Ranch at the owner's expense. Koda Ranch’s puppies/dogs have a lifetime home here at Koda Ranch. Our puppies are NOT sold for resale
DEPOSITS: A non-refundable deposit of half the total price will hold the puppy of your choice until puppy is weaned. Full and final payment is required on puppies that are 6 wks and older. If final payment has not been made by the time the puppy is 6 wks old the deposit will be lost. If shipping or other arrangements are not made by 9-10 wks of age or a puppy/dog is not picked up at it's scheduled time to leave a boarding and maintenance fee of $10.00 per day will be added to the sales price and must be paid before the adult or puppy leaves to it's new home. Koda Ranch does not refund money for purchased puppies that are not picked up or taken by their new owners. Once a puppy or dog is purchased it is the new owners responsibility to pick it up and to provide a clean and healthy environment and to give their new pet love and attention. Again, if a puppy/adult dog from Koda Ranch cannot be cared for in this manor they will always have a home with us and must be returned at the owner's expense. We do not give refunds for buyer's remorse. It is a new owner’s responsibility to make sure they are ready for a new pet and educated in making their decision to welcome a new family member into their home.
When reserving unborn puppies, the same non-refundable deposit will be required. That deposit will be applied toward the purchase of another dog or puppy in the event that the desired puppy is not born, or is not available. The deposit will not be refunded for puppies due to cancellations.
All puppies are sold on a limited registration unless prior arrangements have been made with breeder for an additional fee. We reserve the right to retain or limit the registry regardless of deposit if we feel the puppy does not meet certain AKC standards. If the puppy is retained or it’s registration Limited for any reason after a deposit is made, you may apply it toward the purchase of another puppy/adult or reserve a puppy from a future litter. In no event will the deposit be returned. All puppies are guaranteed against life threatening hereditary or genetic defects until one year of age. If a puppy/dog develops a hereditary or genetic defect and it is documented by a licensed veterinarian and confirmed by one of our veterinarians or veterinarian of our choice we will replace that puppy/dog with another puppy of equal value. No refunds. The effected puppy/dog must be returned with all AKC registration and documentation at buyers expense.
SHIPPING / TRANSPORTATION CHARGES: We ship nationwide out of Bangor Airport in Bangor, Maine. All shipping costs are the responsibility of the buyer, along with any costs for special health requirements. The cost of a standard Veterinary Certificate of Inspection is $30 (our cost, per certificate, not per animal), and will be issued with every animal sold.....NO EXCEPTIONS. Please note – Bangor Airport is a round trip drive of 250 miles for us and we add $50.00 to the shipping charges to cover our mileage. Again, we ship as a courtesy. Shipping crates are $45.00. Shipping charges vary according to weight of puppy and crate, shipping supplies required, and destination. Puppies are shipped at 8-14 weeks old as a courtesy to our clients unless other arrangements have been made. They will have had all veterinarian recommended vaccines. At the time of placement in its new home the puppy or adult will be weaned from its’ dam and eating dry food.
Any puppy/dog leaving Koda Ranch will be healthy and have been checked by our vet and issued a health certificate before shipping. We take every precaution to insure the safety of all of our animals, but because we have no control over the animal once it leaves our kennel, Koda Ranch accepts no responsibility for death or illness of animals which may be brought on by/ or as a direct result of shipping or exposure to other animals and environments. We do guarantee the health of the puppy for 10 days after purchase and shipment, and the puppy must be seen by a veterinarian within 10 days after shipment. If the puppy dies or becomes sick from an illness within the 10 day guarantee time, Koda Ranch will replace the puppy or adult only after an examination made by a Koda Ranch veterinarian. All AKC papers must be returned with the puppy or dog. The puppy or adult must be returned to Koda Ranch at the expense of the buyer. Any claims as a result of this guarantee must be made within the 10 day period, accompanied by a veterinary statement. This guarantee does not cover well puppy visits, regular vaccines, deworming, or any other veterinary care or medication. If anything is found it must be documented by a licensed veterinarian and confirmed by our veterinarian and will be handled one of three ways as listed in Chapter 745 Sale of Dogs and Cats, Subsections 4155, 4156 and 4157 (which will be attached to this sales contract/health guarantee as required by the State of Maine, Department of Agriculture, Animal Welfare Program.)
"A STATEMENT OF MAINE LAW GOVERNING THE SALE OF DOGS AND CATS: The sale of dogs and cats is subject to consumer protection regulations. Maine law also provides safeguards to protect pet dealers and animal purchasers. Attached is a copy of the Maine Revised Statutes, Title 7, Chapter 745. Contained in this law is a statement of your consumer rights and remedies.”
Any legal filings by the buyer must be filed in the Houlton, Aroostook County, Maine Jurisdiction and the buyer will be responsible for all legal expenses incurred by Koda Ranch in any case filed by the buyer that is ruled in the favor of Koda Ranch.
